The common law
On Christmas day 1066 William the conqueror was crowned in Westminster Abbey.
He distributed the conquered lands to his Norman nobles, he took care to retain about a quarter.
So the king's power was always greater than that of any one of his barons.
With Normans,the feudal sistem was introduced in England and barons and knights acquired great importance.
The barons were allowed to build castles to dominate the resentful English
Henry II restore order and stability .
His first task was to reduce the power of the barons ,wich he did with the help of professional soldiers.
Knights could now pay the king a sum of money called "scutage" instead of giving the militar service and with this money the king was able to hire mercenaries.
Another way of keep order was to see that law was done to all.
Henry sent travelling judges round land to hold assizes,or courts.
This sistem was called Common Law because was used everywere.
England was unlike the rest of Europe because of this law:
in others european country the legal practice was based on the Civil law of the Roman Empire and the Canonic law of the Church.
English lawers created a entirely different sistem based on custom,comparisons,previous cases and previous decisions.
The trial by jury established itself in place of trial by ordeal.

Così il potere del re era sempre più grande di quello di ognuno dei suoi baroni.
Con i Normanni fu introdotto in Inghilterra il sistema feudale e baroni e cavalieri acquistarono grande importanza.
I baroni furono costretti a costruire castelli per dominare gli inglesi rivoltosi.
Enrico II riportò ordine e stabilità.
Il suo primo intervento fu di ridurre il potere dei baroni ,lo fece con l_aiuto di soldati professionisti.
I cavalieri potevano adesso pagare al re una somma di denaro chiamata "Scutage" invece di dare servizio militare e con quei soldi il re poteva affittare mercenari.
Un altro modo di mantenere l_ordine era capire che la legge era fatta per tutti.
Enrico mandò giudici viaggiatori per le terre per tenere corti o "assizes".
Questo sistema fu chiamato Common Law perché era usato ovunque.
L_Inghilterra differiva dal resto dell_Europa per la questa legge : negli altri paesi europei la pratica legale era basata sulla legge civile dell_Impero Romano e la legge Canonica della Chiesa .
I leggisti inglesi crearono un sistema completamente differente basato su tradizione,paragoni,casi precedenti e decisioni precedenti.
Il processo per giuria fu stabilitito al posto di quello per ordalia.
